MONTGOMERY COUNTY RESIDENTIAL DEVELOPMENT STRUCTURE PERMIT
All forms that can be found on the permit website at
https://mctx.org/departments/departments_d_-_f/environmental_health/permitting/index.php will have an asterisk (“*”).
Every fully enclosed structure and/or addition requires its own permit. Each living structure requires its own
separate address. Visit www.mc911.org, and select “Addressing” to request a new address or to verify an address.
Any development in the 100 year floodplain (enclosed or not) requires a permit. Additional Development
Permit Non-Structure applications, may be required.
THE FOLLOWING DOCUMENTS WILL BE REQUIRED FOR THE ONLINE SUBMITTAL PROCESS:
Please have ready to upload BEFORE beginning application. We do not accept incomplete submittals.
DEVELOPMENT PERMIT
- Copy of complete legal description of subject property. Subdivision name, section, block, and lot (recorded plats) OR written metes and bounds description/survey. No larger than letter size paper 8 ½ “x 11”.
- *Completed “Storm Water Management Program Compliance Certification”.*
- Site plan or survey of property with exact location of new and/or existing structures. No larger than letter size paper 8 ½ “x 11”.
- Letter from Public Utility Provider (on company letterhead and dated within one year) stating water and/or sewer will be provided to property.If septic is located in SJRA territory, you must provide the SJRA Septic Permit as proof of sewer.
- For properties located in the ETJ or planning area of the City of Houston, a Certificate of Compliance or a Development Approval Form (Form 101) is required from the City of Houston Engineering/Planning Department. This does not apply to properties located in recorded subdivisions with no changes.

FLOODPLAIN PERMIT ADDITIONAL DOCUMENTS (IF APPLICABLE)
For development on property in the floodplain/floodway, the following additional items may be required. Please review the “Steps for Development in the Floodplain” or “Development Permit Non-Structure” located at
https://mctx.org/departments/departments_d_-_f/environmental_health/floodplain.php.
- Property Survey (Property must have been created by a licensed surveyor that clearly shows all existing and proposed structures, septic tanks, and floodplain/flood way boundaries located within the designated tract.)
- *Class B Form 1 –Certificate of Conformity*
- *Class B Form 2 –Notification of Requirement for Final Elevation Certificate*
- *Class B Form 3 –Regulations for Manufactured Homes*
- Hydraulic and Hydrologic Analysis
- Geotechnical Report
- Foundation Design
- Variance Letter for Septic
- Calculations for Septic
- Strap design for septic tanks
SEPTIC PERMIT ADDITIONAL DOCUMENTS (IF APPLICABLE)
Please review the Septic System Checklist located at
https://mctx.org/departments/departments_d__f/environmental_health/permitting/septic_permits.php.
- Floor plans – of every building attached to the septic system.
- *Disclaimer – Signed by the property owner and notarized.*
- * Septic Disclaimer – Signed by the property owner and notarized (conventional systems only).*
- *Filed Affidavit to the Public – Signed by the property owner and notarized (aerobic systems only).*
- *Filed Affidavit to Join – Signed by the property owner and notarized (septicsystem is on 2 lots).*
- *Two Year Maintenance Contract – Signed by the property owner.*
- Current Maintenance Contract and most recent Inspection Report (dated within the year, existing systems only)
- Site and Soil Analysis – Stamped, signed, date within 1 year from a registered Sanitarian or Professional Engineer.
- Septic Design – Stamped, signed, date within 1 year from a registered Sanitarian or Professional Engineer.
- Letter from Registered Sanitarian – Stamped, signed, date within 1 year (conventional systems only).
- Floodplain Determination Letter – When the property is located within municipal boundaries, the city must provide this letter.
- If the development is located in the city limits of Patton Village, a city building permit will be required.
